Terms of Service

1. Agreement to terms
These Terms of Service (“Terms”) govern your access to and use of SiteSpark (the “Service”). SiteSpark is operated by Le Roux Ventures, LLC (“we”, “us”, “our”); “SiteSpark” is a product and trading name of Le Roux Ventures, LLC. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy and Refund Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is accurate.
3. The service
SiteSpark is a website builder that lets you create, edit, publish, and host a website. Features and limits depend on your active subscription plan. We may add, change, suspend, or discontinue features over time, and will give reasonable notice of material changes where practical.
4. Accounts
You are responsible for the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use. You must keep your account information accurate and up to date.
5. Subscriptions, billing, and our payment provider
Paid plans are billed on a recurring basis through our payment provider, Paddle.com (“Paddle”), which acts as the Merchant of Record for all orders. This means Paddle — not Le Roux Ventures, LLC — is the seller of record for your purchase and processes all payments, taxes, and refunds. Your purchase is also subject to Paddle’s Buyer Terms and Conditions.
Subscriptions renew automatically at the then-current price until cancelled — see section 6. Prices are shown exclusive of tax; any applicable sales tax or VAT is calculated and added by Paddle based on your location.
6. Automatic renewal
Subscriptions are offered on a monthly ($9.99) or annual ($90) term, and both renew automatically. Unless you cancel before the end of your current term, your payment method is charged again for a further term of the same length at the then-current price, plus any applicable tax. Monthly subscriptions renew every month; annual subscriptions renew every year.
You can cancel at any time from your account settings, which stops all future renewals. Building and previewing a site is free and requires no payment method; new subscriptions do not include a free trial. Subscriptions created before 12 August 2026 may include a 7-day free trial, which runs to its original end date.
7. Cancellation and refunds
You can cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period, and your published site is taken offline at that point. If a renewal payment fails, we allow a short grace period (currently 7 days) for you to update your payment details before your published site is taken offline. Refunds are governed by our Refund Policy — which includes a 30-day money-back guarantee — by Paddle’s Buyer Terms, and by your rights under applicable law.
After your subscription ends we retain your site content for 12 months so you can resubscribe and restore your site; after that period it is permanently deleted. See our Privacy Policy for details.
8. Your content
You retain ownership of the content you add to your site (“Your Content”). You grant Le Roux Ventures, LLC a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display Your Content solely as needed to operate and provide the Service. You are responsible for ensuring Your Content is lawful and does not infringe the rights of others.
9. Acceptable use
You agree not to misuse the Service, including by publishing unlawful, infringing, deceptive, or harmful content; attempting to disrupt, reverse engineer, or gain unauthorized access to our systems; distributing malware or sending spam; or violating any applicable law. We may suspend or terminate accounts that violate these Terms.
10. Intellectual property
The Service, including its software, design, and branding, is owned by Le Roux Ventures, LLC and its licensors and is protected by intellectual property laws. These Terms do not grant you any right in our trademarks or the Service other than the limited right to use it as permitted here.
11. Third-party services
The Service relies on third-party providers, including Paddle (payments), Amazon Web Services (hosting and infrastructure), and MongoDB Atlas (database). Your use of the Service may be subject to those providers’ terms. We are not responsible for third-party services we do not control.
12. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
13. Limitation of liability
To the maximum extent permitted by law, Le Roux Ventures, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid for the Service in the twelve months before the claim arose.
14. Indemnification
You agree to indemnify and hold harmless Le Roux Ventures, LLC from claims, damages, and expenses arising out of Your Content or your breach of these Terms or of applicable law.
15. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service or other users. On termination, your right to use the Service ends and your published site may be taken offline.
16. Governing law and disputes
These Terms are governed by the laws of the State of Pennsylvania, United States, without regard to its conflict-of-laws rules. The courts located in Pennsylvania will have jurisdiction over any dispute not subject to Paddle’s Buyer Terms, except where applicable consumer-protection law gives you the right to bring proceedings in your place of residence.
17. Changes to these terms
We may update these terms from time to time. When we do, we will revise the “Last updated” date below and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms.
